​REACH 

While oleochemicals are often described as “natural” or “bio‑based,” they are still chemical substances placed on the European market, meaning regulation matters.

The European Chemicals Agency (ECHA) is the European Union’s regulatory agency for the conception, implementation, and management of chemicals legislation. Its mission is to protect human health and the environment while supporting innovation and competitiveness in the European chemicals industry.

It oversees various key pieces of chemicals regulation such as:

  • REACH – Registration, Evaluation, Authorisation and Restriction of Chemicals
  • CLP – Classification, Labelling and Packaging
  • BPR – Biocidal Products Regulation
  • PIC – Prior Informed Consent for hazardous chemicals in international trade

REACH is the single most important regulation for oleochemical producers and importers. Companies manufacturing or importing substances into the EU at ≥1 tonne/year must ensure that oleochemicals are:

  • Registered (unless exempt)
  • Assessed for hazards and risks
  • Used safely throughout the supply chain

A key point for oleochemicals is that not all substances need to be registered. Many oleochemicals benefit from REACH Annex IV or V exemptions, due to being:

  • Derived from natural fats and oils
  • Not chemically modified
  • Not classified as hazardous

Even when a substance is exempt from REACH registration, it is not exempt from CLP obligations. Suppliers are obliged to:

  • Assess hazards such as skin or eye irritation
  • Apply appropriate labels and safety information
  • Notify classifications to ECHA’s databases

For oleochemicals used in formulated products, across multiple applications, customer segments and higher concentrated forms.

Some oleochemicals are used in biocidal applications, such as disinfectants or preservatives. In this case the Biocidal Products Regulation (BPR) may apply, bringing higher regulatory requirements.
